OCHRONA WÓD

Art. 97. 1. Ochrona wód polega na zapewnieniu ich jak najlepszej jakośi, w tym utrzymywaniu ilośi wody na poziomie zapewniająym ochronęrównowagi biologicznej, w szczególnośi przez:
1) utrzymywanie jakośi wód powyżj albo co najmniej na poziomie wymaganym w przepisach,
2) doprowadzanie jakośi wód co najmniej do wymaganego przepisami poziomu, gdy nie jest on osiąnięy.
2. Poziom jakośi wód jest okreśany z uwzglęnieniem ilośi substancji i energii w wodach oraz stopnia zdolnośi funkcjonowania ekosystemów wodnych.
Art. 98. 1. Wody podziemne i obszary ich zasilania podlegająochronie polegająej w szczególnośi na:
1) zmniejszaniu ryzyka zanieczyszczenia tych wód poprzez ograniczenie oddziałwania na obszary ich zasilania,
2) utrzymywaniu równowagi zasobów tych wód.
2. (188) Do celów, o których mowa w ust. 1, tworzy sięw szczególnośi, na zasadach okreśonych ustawą- Prawo wodne, obszary ochronne zbiorników wód śódląowych.
3. Jeżli przepis szczególny nie stanowi inaczej, wody podziemne przeznacza sięna zaspokojenie potrzeb bytowych ludzi.
Art. 99. (189) Organy administracji planująi realizujądziałnia w zakresie ochrony poziomu jakośi wód uwzglęniająe obszary zlewni hydrograficznych.
Art. 100. 1. Przy planowaniu i realizacji przedsięzięia powinny byćstosowane rozwiąania, które ograniczązmianęstosunków wodnych do rozmiarów niezbęnych ze wzglęu na specyfikęprzedsięzięia.
2. Jeżli konieczna jest czasowa zmiana stosunków wodnych, jest ona dopuszczalna wyłuc0ąznie w okresie niezbęnym.
3. Każy, kto czasowo doprowadziłdo zmiany stosunków wodnych, jest obowiąany do podjęia działńw celu ich przywrócenia, gdy zmiana ta przestanie byćniezbęna.
